Netspective Communications LLC keeps all confidential information in a safe place and communicates it to relevant parties only, in accordance with the Data Protection Act 1998, in preparation for the EU General Data Protection Regulations 2018 and relevant Netspective Communications LLC policies and guidelines. Netspective Communications LLC will investigate any breach and may take disciplinary action.

Maintenance of Confidentiality & Non-Disclosure

  • Netspective Communications LLC keeps all confidential information in Git;

  • Netspective Communications LLC may use confidential information solely for the purposes of performing their duties as an employee of Netspective Communications LLC.

  • Netspective Communications LLC only discloses confidential information to persons who are aware that the confidential information must be kept confidential and who have a need to know (but only to the extent that each person has a need to know). [FII-SCF-011-HRS-06.1]

  • The obligation of employees and personnel to maintain confidentiality and non-disclosure does not extend to confidential information that they are required to disclose pursuant to an order of a Court or any statutory authority. The employee or person will promptly notify the Netspective Communications LLC of any such requirement to enable the Netspective Communications LLC to take the necessary action as deemed fit by the Netspective Communications LLC in the circumstances.   • At the end of the period of employment, Netspective Communications LLC employees and personnel must return to Netspective Communications LLC:

    • All confidential information in material form;
    • Those parts of all notes and other records in whatsoever form, based on or incorporating confidential information;
    • All copies of confidential information and notes and other records based on or incorporating confidential information; and
    • All of Netspective Communications LLC property and assets, in the possession or control of the employee or personnel.
  • The obligation of maintaining confidentiality and non-disclosure will continue even after the end of the period of employment or engagement in respect of all confidential information.[FII-SCF-011-HRS-06.1]

  • If any employee breaches this confidentiality and non-disclosure obligation while employed by Netspective Communications LLC, the company will discipline them, and in serious instances, dismiss them. If any ex-employee breaches this confidentiality obligation, the company may take legal action against them, depending on the circumstances of the breach, including canceling or withdrawing any benefits extended to the ex-employee by the Company.

  • This policy will operate in conjunction with the contract of employment or letter of appointment for Netspective Communications LLC employees and personnel.

Need to know

  • Netspective Communications LLC employees are only allowed to disclose confidential information on a “need to know” basis, i.e., only when the information is necessary for them to effectively perform their employment duties.

Circumstances in which information can be Disclosed [FII-SCF-018-PRI-07]

  • An employee can disclose confidential information only with the written consent of their reporting superior.
  • If the information is required by or under a Court order or of a statutory authority, the employee or person must promptly notify the Company of any such requirement to enable the Company to take necessary action as deemed fit by the Company in the circumstances.
  • Disclosure of confidential information can be justified for any other purpose, usually for the protection of the public and in relation to the prevention and detection of serious crime. A request for information by the police must be carefully considered.
  • The Netspective Communications LLC employee must be able to justify any decision to disclose information.

Storage of data

  • Netspective Communications LLC employees must not leave any written document containing confidential information visible where it can be read by anyone. This includes telephone messages, computer prints, letters, and other documents. All hardware containing confidential information must be housed in a secure environment. Employees must take security precautions in accordance with the Netspective Communications LLC Policy and Procedures.

The Media [FII-SCF-009-DCH-18]

  • Netspective Communications LLC employees must not pass on confidential information to members of the press or other media communications without the written consent of their reporting superior. All requests from the media must be dealt with under the Netspective Communications LLC procedure for handling media queries.

Disposal of information [FII-SCF-009-DCH-21]

  • Netspective Communications LLC employees may set user information or customer information ready for disposal as blocked and inaccessible.
